Goa Lokayukta starts proceedings against BJP MLA

On Thursday, Goa Lokayukta, Justice P K Mishra, on his last day, initiated proceedings against legislator from ruling party,BJP-Pandurang Madkaikar in a disproportionate assets case. He also pulled up the state government and Anti-Corruption Bureau (ACB) officials for dereliction of duty.

Justice Mishra, on Wednesday, based on another complaint, had initiated proceedings and had pulled up the Labour Department and directed ACB to file an FIR against people who allegedly siphoned off money from the Building and Other Construction Workers (BOCW) Welfare Fund.
CBI also has been asked by him to intervene if the preliminary probe found “possible involvement” of any politician.

Justice Mishra, on Wednesday, initiated proceedings on a complaint by advocate Aires Rodriques, alleging that the BJP MLA had had a huge building valued at around Rs 200 crore constructed under his real estate business, Nikitasha Realtors Private Limited. This is in contradiction with his declaration in the election affidavit that his income was at less than Rs 1.5 lakh. In 2018, this complaint had been filed when Madkaikar was a minister in the Manohar Parrikar-led government.

Allegations had been denied by Madkaikar, and he also stated in his reply to the Lokayukta that the building concerned was constructed by Nikitasha Realtors, which is a separate private company in real estate business. The reply stated that Madkaikar, being MD of such a company, was only allowed to stay in such building.

It has been noted by Justice Mishra that Parrikar had then endorsed that since the complainant had approached the Lokayukta, the ACB need not to pursue the matter, thus avoiding any further probe.

In his order, Lokayukta Mishra wrote that it was evident that ACB and the then Chief Minister have shirked and shied away from their responsibilities by not registering FIR and conducting any investigation on the pretext that the matter was pending before the Lokayukta. Justice Mishra further added that there was no doubt that the Respondent No 3 [Madkaikar] belonged to the ruling party and the ACB may hence had become sluggish in its investigation.

If the investigation is not done properly, Mishra had suggested that the complainant could approach relevant authorities for a CBI probe.

Justice Mishra, on Wednesday, in another order, came down heavily on politicians, ordering an FIR to be registered by the state ACB against unknown persons for conspiracy to siphon out funds of Goa BOCW Welfare Funds to members of the public with a view to distribute largesse. The Lokayukta’s order stated that both of the cases will now be probed by the ACB, and any gaps in probe will allow the complainants to approach the CBI.

Bundle of Falsehood- BJP Accused Congress

The Congress on Friday announced names of 15 candidates for the upcoming by-elections to 27 Assembly constituencies in Madhya Pradesh.

The party has fielded Ravindra Singh Tomar (Dimani), Satyprakash Shekharwar (Ambah, SC), Mevaram Jatav (Gohad, SC), Sunil Sharma (Gwalior), Suresh Raje (Dabra, SC), Phul Singh Baraiya (Bhander, SC), Pragilal Jatav (Karera), Kanhaiyalal Agrawal (Bamori), Asha Dohre (Ashok Nagar, SC), Vishwanath Singh Kunjam (Anuppur, ST), Madanlal Choudhary Ahirwar (Sanchi, SC), Vipin Wankhede (Agar, SC), Rajveer Singh Baghel (Hatpipalya), Ram Kishan Patel (Nepanagar, ST) and Premchand Guddu (Sanver, Sc), state Congress spokesman Narendra Saluja said.

This referred to a survey reportedly conducted by the Rashtriya Swayamsevak Sangh (RSS) and the BJP to argue that the opposition party will win 22 out of 27 seats up for by-polls in the state.

The BJP which has to win a minimum of 9 of the 27 seats to continue with it’s government, has however called the Congress’s claim a “BUNDLE OF FALSEHOOD”.

This claim comes on the eve of the four-day joint by Chief Minister Shivraj Singh Chauhan and Rajya Sabha member Jyotiraditya Scindia of the Gwalior Chambal region, wherein they will supervise foundation-laying processions for various developmental projects and works.

This all results with a series of tweets by the MP Congress holding local media reports on the survey to say that the people have decided to teach BJP a lesson. They have declared that Congress will win 22 seats according to RSS survey and this will be the win of the masses.

They have also said that the BJP has begun discovering excuses to deny tickets to Congress ex-MLA’s who switched over to the BJP through this survey.
The RSS has reportedly proposed that some of the ex-MLA’s should not be fielded to diffuse the negativity among public.

Meanwhile, during the series of meeting clasped on Wednesday, the national organising general secretary of BJP,B.L.Santosh has said that the ministers in charge of the 27 constituencies will be held personally accountable for the result on these seats and thus they should put in all efforts to assure their party wind.

MLA murmurs: Uttarakhand BJP MLA denounces government officials behaviour

BJP MLA and former party state president Bishan Singh Chuphal denounced the government officials and bureaucrats in Uttarakhand that they are not listening to party MLAs making them face a difficult situation in their constituencies.

A legislator from Didihat constituency in Kumaon, Chuphal, has reportedly been interacting with other party MLAs who are unhappy with their voices not being heard. This advancement has come at a time when the party has commenced its preparation for the assembly elections scheduled in 2022.

A few days back when BJP state president Bansidhar Bhagat affirmed that rather than banking on PM Narendra Modi’s name, MLAs themselves need to work hard in their constituencies for getting votes. This led to a controversy.

Later, Bhagat tried to clarify the controversy with Opposition Congress leaders saying that it meant the Modi wave had ended. Bhagat said, “PM Modi is the greatest and the most influential leader of the world and the party will make people aware of projects being carried out in the state with his blessings.”

Chuphal, speaking about the fresh developments, said, “We are unhappy that the officials are not listening to us. They are not ready to address our issues or resolve them.” On dissent against the party leadership and his efforts to gather like-minded party MLAs from the Kumaon region, Chuphal said, “We have no issues with the party leadership but the officials.”

“As far as meetings are concerned, I am meeting all kinds of people who come to me with their different issues. As a public figure, it’s my job to resolve their issues. However, the government should do something on the issue of officials not listening to us as public representatives,” he added.

Meanwhile, The political authorities, assert that the development involving some sort of dissidence among the party MLAs, especially Chuphal has much to do with the Cabinet augmentation, as there are three ministerial berths yet to be filled.

However, political analyst SMA Kazmi, who has been keeping an eye on state politics for over a decade, said, “Chuphal is using pressure tactics considering the Cabinet expansion regarding which there were reports that it was going to happen soon.”

“Being a senior MLA, he was unhappy since he was not made minister in the Cabinet after the party came to power in 2017. Now, when only less than a year is left, he is trying to pressurise the party leadership for getting a ministerial berth,” he added.

He also stated, the issue of officials not listening to the party MLAs is also significant as ‘MLAs have to face the public in their area.’

Meanwhile, it has become a great opportunity for opposition congress to take a dig on BJP, Which often attacks ‘factionalism and differences in the state Congress.’

Indira Hridayesh, Congress leader in the state, said the current developments show that all was not well in the ruling party. “MLAs are complaining that neither development is being done nor the officials are listening to them. The public is not happy with this too,” she said.

“Despite a heavy majority, the government is not able to deliver. If it’s not focused on development even now, then the public will soon come out in protest on the roads,” she added.

The BJP, nevertheless, tried to downplay the advancements and said, ‘some MLAs have put their issues before the party forum.’

“There are no variances with the party leadership but there are issues regarding the government administrators. Those have been put at the party forum by some MLAs which are being addressed by the leadership in the party as well as the state government,” said Devendra Bhasin, BJP state vice-president.

PIL in Jharkhand high court seeks to move Lalu Prasad back to jail

RJD chief Lalu Prasad Yadav, convicted in the fodder scam case, is in the Kelly Bungalows of Rajendra Institute of Medical Sciences (RIMS). But a Kelly bungalow has become an important center of Bihar politics.

Even though the assembly elections are held in Bihar, this bungalow has become the main center of Ranchi and the leaders and workers of Bihar are constantly turning to this bungalow. But due to this, Lalu’s difficulty may increase, because the public interest petition has been filed in the Jharkhand High Court by petitioner Manish Kumar, alleging violation of the jail manual.

The petition said that Lalu Prasad Yadav is continuously violating the jail manual and defying the order of the court by meeting hundreds of people daily. On the matter, the petitioner’s advocate Manoj Tandon said that the Central Home Secretary, including the Home Secretary of CBI, Jharkhand, has been made the defendant.

Significantly, even before Lalu Prasad Yadav was staying in the BMP Guest House even after going into judicial custody in the fodder scam, the Supreme Court immediately passed a judicial order by SLP CRL 2296/1998 Order dated 27.11.1998 Under Lalu, Beur was taken to jail. This order has also been mentioned in the PIL.

Actually, RJD supremo Lalu Prasad Yadav is convicted in various cases of fodder scam. But due to his unwell health, he is undergoing treatment at RIMS. He was in the paying ward of RIMS, but looking at Covid-19 (COVID-19), he has been shifted to the RIMS director’s bungalow ie Kelly Bungalow.

BJP gears up to face Oppn in Parliament

The Bharatiya Janata Party is poised to face an aggressive opposition that will try to surround the government on issues ranging from the covid-19 epidemic to the Facing between Indian and Chinese forces in the Galwan Valley of Ladakh. It is likely to be on 14 September when the Parliament will reorganize for the monsoon session.

The opposition, mainly Congress, has been attacking the government over the response to the epidemic and accused the government of not doing enough to stabilize the economic recession following the nationwide lockdown n March.

The Congress has accused the government of not allowing 20 soldiers to be transparent, citing the details of the Galwan clash. A BJP official said, “The questions raised by the opposition regarding China and the epidemic have already been answered and they are only using these issues for petty politics.”

According to the party official, 10 ordinances were passed this year and came up for consideration after the last session in March.

In December 2019, the Data Protection Bill, 2019, introduced in the Winter Session, deals with data collection and sharing rules, and defines rights to citizens on their personal information.

The Official said, “The government hopes that all four codes will implement wages, industrial relations, social security and occupational safety, health and working conditions.”

Occupational Safety, Health and Work Conditions Code, 2019; The Code of Industrial Relations, 2019, and the Social Security Code have all been referred to parliamentary committees.

BJP asks Anna Hazare to join ‘mass movement’ against AAP

On Monday, Delhi BJP president Adesh Gupta urged social activist Anna Hazare by writing a letter, to join party’s “mass movement” against the government led by AAP, which he alleged was the “new name of social, political and economic corruption.”

Gupta, In his letter, claimed that “political purity” has been destroyed by AAP government and also accused it of “planning” the northeast Delhi riots in February, which had left at least 53 people dead and around 200 injured.

“The Aam Aadmi Party, which came to the government in the name of clean and fair politics, has demolished all the parameters of political purity,” Gupta wrote in his letter to Hazare.

AAP did not give an immediate reaction on Gupta’s letter. BJP has been attacked by AAP, levelling allegations of corruption in the three municipal corporations ruled by the party and also in connection with the riots in the city.

The two sides have been denouncing each other on certain issues, which includes corruption, waterlogging and civic amenities in the city along with the riots, in the run up to the civic body polls due in 2022.

“The people of Delhi have suffered the communal riots planned by the AAP,” Gupta said in his letter.

“The voice of Anna Hazare will have to be raised again for the relief of the youth and for people of Delhi who feel betrayed by the Kejriwal government,” Gupta said.

Kejriwal was known as a frontline leader of the anti-corruption movement launched by Anna Hazare from Ramleela ground in Delhi in 2011.

Curbs at rallies, booths likely in first Covid-19 polls

Amid covid-19 pandemic the first set of elections to be held in India – particularly Bihar assembly polls – guidelines with restrictions on public presence at campaign rallies has been finalised by the Election Commission of India (ECI)  in door-to-door political outreach, in polling booths, and inside counting halls, to ensure strict social distancing, four officials familiar with the decision-making process told HT.

The contours of ECI’s new plan for elections in the “new normal” are being adopted even as political parties have offered varied suggestions to the constitutional body, from deferring polls altogether to holding them in one phase, from reverting to ballot papers to allowing physical (and not just virtual) rallies, and from increasing the limits on poll expenditure by candidates to exempting those expenses incurred while enhancing Covid-19 precautions.

ECI received the inputs from State election officials, too.

Since the pandemic took place, while elections have taken place in other countries including in Sri Lanka recently, elections in India have only been confined to polls to the Rajya Sabha and legislative council seats, which involve a limited set of voters.  Experts believe that the election paradigm adopted for Bihar will have significant implications for political contests, and have a medium-term impact since other state elections are due in the middle of 2020.

On Friday,  suggestions received from political parties has been reviewed by ECI,to conduct elections to the 243-member Bihar assembly (its term ends in November) and subsequently held a meeting on Tuesday to discuss a wide-ranging organisational framework, is likely to issue the guidelines over the next three days. Elections to the Samastipurparliamentary constituency and 56 assembly constituencies (across eight states) elsewhere are also scheduled to be held from September, officials familiar with the matter said.

”Polling stations, counting halls and public meetings would be the three subjects where the guidelines would be centred around,” said an ECI official. “For example, in the counting hall we used to have 14 tables, now we have slashed the number to seven.”

Physical rallies

Rallies plays a vital role for political parties, which have traditionally served as a key political tool for mobilising voters and communicating messages by leaders. Due to this pandemic and push towards digital campaigning, the main concern for the parties is that the direct interface with voters, especially those who lack digital access, will get affected if physical rallies are not allowed.

Since the voters in rural and semi-urban areas may not have access to mobile devices and the internet, The Bharatiya Janata Party (BJP), which is part of the ruling dispensation in Bihar, has asked the poll panel to allow physical meetings and rallies in the rural and semi urban areas, people familiar with the matter said.  In its submission to ECI, the party has said that all party workers, campaigners and leaders must have the Aarogya Setu app downloaded on their phones at all times, and adequate social distancing has to be maintained during roadshows and processions. In case, physical rallies are permitted, the party has suggested having enclosures with limited seating, separate exit and entry points, and use of sanitisers and thermal scanners at all points of entry and exit.

Other parties such as the Rashtriya Janata Dal (RJD) and a BJP ally, the Lok Janashakti Party (LJP), too have said that till physical rallies are allowed, elections must not take place.

Poll expenses

The other concern for parties is poll expenses. The limit on expenditure should be increased for the candidates, or alternatively all expenditure which is borne on purchasing equipment to safeguard against Covid-19 be exempted from being charged to the candidates account, suggested BJP. There have been other suggestions on how there should be new limits on social media expenditure of parties given the increased reliance on digital medium due to the pandemic.

“Social media campaigning was always allowed, even before the pandemic. Expenditure limits that exist will apply,” official said. Political parties do not have a limit on the expenditure, but a candidate is allowed to spend a maximum of ₹28 lakh, including all election costs.

Directions for the number of electors per polling booth will be limited to a maximum 1,000 compared with 1,600 earlier has been issued by the Commission. A number of auxiliary polling stations will be created to accommodate the voters. Chief Election Commissioner Sunil Arora on June 27 told HT that 36,000 polling stations will be created in Bihar.

Other suggestions

Voters should be given ballet paper so that they are not susceptible to the infection while pressing the buttons on the electronic voting machines (EVMs) suggested The Congress, the RJD and All India Majlis-e-Ittehad-ul-Muslimeen. This demand, officials indicated, is unlikely to be met.

By polls in some states should be postponed even further. On August 14, HT reported that chief secretaries of Madhya Pradesh, Haryana and Gujarat, and the chief electoral officer (CEO) of Kerala, had written to the commission, citing rising Covid-19 cases and heavy rains, to consider deferring the by-polls.

There will not be much of a difference to the functioning of the assembly if one or two  by polls defers. However, if assembly elections are deferred, President’s rule will have to be imposed. That can only be done under two circumstances which constitute an emergency — external aggression and internal rebellion, said Quraishi.”

Quraishi also said that the EC should consider capping expenditure by political parties on campaign.

AAP claims Shaheen Bagh protests were planned by BJP; saffron party hits back

The Aam Aadmi Party (AAP) alleged on Monday that the anti-CAA protests at Shaheen Bagh were “scripted and strategised” by the BJP and that the over three-month-long road blockade led by a large number of Muslim women was designed to benefit the BJP in the assembly polls held earlier this year.

It also accused the BJP of engineering the communal violence later that month in northeast Delhi that left 53 people dead and around 400 injured.
Addressing a digital news conference, AAP chief spokesperson Saurabh Bharadwaj said “pro-democracy” citizens must be feeling “cheated and manipulated” as the “BJP pulled the strings” of the protest that they had joined.

“The Shaheen Bagh protest was the BJPs main election issue… the BJP stands exposed now as the organisers of the Shaheen Bagh protests have joined BJP,” said AAP’s Saurabh Bharadwaj, accusing the BJP of polarizing Delhi to win the election.

The BJP denied AAP’s allegations and said the party led by Arvind Kejriwal was making baseless claims to garner support from the minority communities ahead of the municipal elections in the capital. due to take place sometime in April 2022. The last municipal elections in Delhi took place on April 23, 2017 and the BJP managed to win a majority in all three civic bodies.

“The AAP has misled people in Delhi, especially the Muslim community, for its political gains. Their allegations have no meaning as the Muslim community supports the BJP and Prime Minister Narendra Modi. Now, with the municipal elections scheduled in 2022, the AAP is nervous about losing its support base in the community,” said Delhi BJP chief Adesh Gupta.

AAP’s attack came a day after the BJP announced that several Muslim residents of Shaheen Bagh, which was the epicentre of anti-CAA protests for months, have joined the party.

Narendra Modi becomes the longest-serving non-Congress prime minister

Before coming to Delhi, Prime Minister Narendra Modi was Chief Minister of Gujarat for 13 years.

BJP said on Thursday that Narendra Modi has become the longest-serving non-Congress Prime Minister of India and the fourth highest serving Prime Minister of the country overall.

He has also become the non-Congress Prime Minister of the longest-serving country. Former Prime Minister Atal Bihari Vajpayee served a total of 2268 days during all his tenures. Today, Prime Minister Modi overtook him. Ashok Gehlot planning to go for floor test soon; despite the return of Sachin Pilot camp

Ashok Gehlot will opt for a floor test in the upcoming assembly session despite an announcement by 19 disgruntled Congress MLAs, whose rebellion jeopardized the government’s stability last month, with At least three party leaders told about the development on Wednesday.

Even though the 19 MLAs, including the now sacked Deputy Chief Minister Sachin Pilot, have returned to the Congress, the party feels that the only way to send a message of unity after a sharp month is a floor test. This triggered political uncertainty in the western state.

A Congress leader, requesting anonymity, said, “No doubt, a floor test is the only solution and we can go for it at any opportune time. We will prove our majority on the floor of the House.”

A three-member All India Congress Committee panel constituted to look into the grievances of Pilot and rebel MLAs is likely to submit its report by then.

The Rajasthan crisis seemed to end after a meeting between Pilot and former Congress president Rahul Gandhi on Monday.

With the return of Pilot, the Congress alone has 107 MLAs in the 200-member Assembly, with a simple majority of 101.

Another Congress official, who is monitoring the developments in Rajasthan, said that the government can transfer the confidence vote in the assembly at any time.

A third congressman said that a floor test was important to prove a point.

The BJP said that calling on a floor test was an “internal issue” of the Congress.

Political analyst Narayan Bareth said that the Congress does not want to take any risk.

Despite the truss, there are signs of resentment among a section in Congress.

The MLAs who supported Gehlot expressed their anger at the Congress Legislature Party meeting in Jaisalmer over the return of Pilot and his supporters.

A party leader present at the meeting said that a large section of legislators were vocal against Pilot, and questioned how the Congress could withdraw dissidents after threatening the government.
