Farmers’ protests: Thousands had converged for ‘kisan mahapanchayat’ in UP’s Shamli defying prohibitory orders under Section 144 of CrPC

The farmers’ protests are getting a shot in the arms through the Mahapanchayats being organized.

Thousands of farmers turned up for a meeting in Shamli district in western Uttar Pradesh on Friday amid a growing clamour against the Centre’s agri-marketing laws in the region.

People from Shamli and nearby districts started reaching Shamli’s Bhainswal village on tractors, two- and four-wheelers and on foot for a ‘kisan mahapanchayat’ being held there by the Rashtriya Lok Dal (RLD).

The people gathered there despite the Shamli administration denying permission for the meeting and imposing prohibitory orders under section 144 of the CrPC.

This is the fourth major farmers’ meeting in western Uttar Pradesh after Muzaffarnagar, Mathura and Baghpat, besides some in Haryana, to support the ongoing stir against the farm laws.

Scores of regional ‘khap’ leaders, Bharatiya Kisan Union members and RLD vice president Jayant Chaudhary, among others, attended the event, even as security personnel were deployed in large numbers in the area.

RLD leader Chaudhary had on Thursday tweeted that there are “144 reasons why I will go to Shamli tomorrow”, attaching to it a news article on the denial of permission for the event by the Shamli district administration.

The RLD has already extended support to the ongoing peasants’ demonstrations at Delhi’s borders and in parts of Uttar Pradesh, Punjab, Haryana and Rajasthan.

The party’s farmer outreach programmes which began on Friday in Shamli are further scheduled to be held in Amroha, Aligarh, Bulandshahr, Mathura, Agra, Hathras, Pilibhit in Uttar Pradesh and a couple of them in Rajasthan during the February month.

In a parallel development, Farmers in Agra have asked 9 MLAs & 2 MPs to support farmers or face ‘social boycott’ in their mahapanchayat.

Bharatiya Kisan Union (BKU) leader Rakesh Tikait has said that the ‘Chakka Jam’ (blockading of roads as a form of protest) planned on February 6 will not take place in Delhi, but will happen in other parts of the National Capital Region and the rest of the country, including the southern states.

Bird Flu update: cases detected in UP & sale of poultry products banned in Delhi

As the country is tackling the Covid19,  Bird flu has arrived as the new headache for the administration, health departments and the poultry industry units across various states and UTs in the country.

Bird deaths reported from UP’s Jalaun district

Officials stated that five birds, mostly crows, have been found dead in Uttar Pradesh’s Jalaun district, amid cases of avian influenza in the state. Though samples have been sent for testing, it seems that the birds died due to cold, they said.

The deaths were reported from Bamhori and Islamabad localities of Kadaura village over two days, veterinary officer Dr Vipin Sachan said, adding that officials have been asked to be alert.

“In the Bamhori and Islamabad localities of Kadaura hamlet, two crows and a bird were found dead on Tuesday, while on Monday death of two more crows was reported,” he told PTI.

“Postmortem was conducted and prima facie, symptoms of bird flu were not found. Even then, samples have been sent for testing,” Sachan added.

Two teams consisting of six members each have been deployed to examine poultry birds, he said.

Poultry products banned in three MCDs

In the wake of the bird flu outbreak, which has been confirmed in nine states and one Union Territory so far, all the three MCDs – North, South, and East on Wednesday banned the sale and storage of poultry or processed chicken meat by shops and restaurants with immediate effect.

The order also stated that the owners of restaurants and hotels will face action if egg-based dishes or poultry meat and other products are served to customers.

The order came days after samples of crows and ducks had confirmed bird flu cases in the national capital. The Ghazipur poultry market has also been closed by authorities. “All meat and poultry shops and meat processing units in areas under the NDMC, are prohibited to sell, store poultry or processed or packaged chicken meat with immediate effect, till further orders,” the order said.

Several ducks at Sanjay Lake and a considerable number of crows across various city parks had been found dead last week.

As of now, the bird flu outbreak has been confirmed only in Delhi, Uttarakhand, Uttar Pradesh, Kerala, Rajasthan, Madhya Pradesh, Himachal Pradesh, Haryana, Maharashtra and Gujarat, according to the Union fisheries, animal husbandry and dairying ministry. It also said that unusual mortality among birds has also been reported in some districts of Jharkhand and Jammu and Kashmir.

Thane District incharge Rajesh Narvekar instructed the forest department to pay special attention to wetland areas for migration of birds. Seven rapid response teams have been deployed in the district and a control room has been activated to monitor the bird flu situation, he was quoted as saying by PTI during a review meeting with senior officials.

If crows, parrots, herons or migratory birds are found dead, the authorities should be informed immediately, he added. Also, if more deaths than usual are observed among birds in a commercial poultry farm, the nearest veterinary clinic should be informed immediately, a release said quoting Narvekar.

Meanwhile, the Delhi Health Department issued an advisory in view of bird flu cases in the city, asking people not to panic and follow a set of dos and don’ts, including not consuming half-cooked chicken, half-boiled or half-fried eggs.

The advisory issued by the Directorate General of Health Services (DGHS) of Delhi stated, “H5N8 is highly pathogenic in birds but the pathogenicity in humans as well as the likelihood of human infection with avian influenza (AH5N8) virus is low.” While issuing the dos and donots, the health department has asked people to observe precaution and to not panic.

“Avoid contact and prevent exposure from sick-looking sluggish chicken. Avoid direct contact with bird secretions and droppings,” the advisory stated, adding that bowls used for feeding birds, and their cages should be washed properly with soap or detergent.

All slaughter waste must be disposed off properly, the DGHS authorities were quoted as saying.

The advisory also cautioned people to not touch dead birds with naked hands. If any bird is found dead, control room should be informed at phone number 011-23890318.

UP introduced the law of prohibition of unlawful religious conversions-‘love jihad’ while Allahabad High Court clears the air

On November 24, the Uttar Pradesh government cleared the pending legislation on the unlawful religious conversions also referred to as ‘love jihad’. The law is against inter-faith marriages which are done with the sole intention of changing the girl’s religion. As per this law, the guilty will be sentenced to jail for up to 10 years and the marriage will be declared ‘null & void’.

As per a government statement released with regards to this matter, the people who are found violating this law shall be sentenced to 10 years of jail. In case, the conversion was done through cheating or atrocity, and forcibly, the term would be ‘non-bailable’.

Sidharth Nath Singh, the UP-cabinet minister and government spokesperson described this as a ‘big decision’ taken by the state government as it was necessary to ensure law and order in UP. He also added that it was important

to ensure women’s safety as over 100 cases have come to notice where such unlawful conversions were done to change the girl’s religion forcibly. Singh also shared that as per the law, the guilty would be sentenceded to 1-5 years of jail alongwith a minimum fine amount of Rs. 15,000, and in case the girl belongs to the Scheduled Caste or Scheduled Tribe, the fine amount increases to Rs. 25,000 alongwith a jail term of 5-10 years. Similarly, if a ‘mass conversion’ is carried out, the guilty will have to pay a minimum fine amount of Rs. 50,000 and would be sentenced to jail for 3-10 years.

However, if someone wishes to change their religion willingly after marriage, he/she will have to apply to the district magistrate 2 months in advance and can do so after being permitted.

The UP-state law commission had submitted a report and a draft for ‘Uttar Pradesh Freedom of Religion Act, 2019’ to the UP Chief Minister, Yogi Adityanath suggesting him to declare a marriage null and void in case of unlawful religious conversions taking place in the name of marriage.

The ‘Uttar Pradesh Vidhi Virudh Dharma Samparivartan Pratishedh Adyadesh 2020’ was introduced faster than expected after the CM recently declared that the people supporting ‘love-jihad’ should mend their ways or face consequences, at a public meeting in Jaunpur. Apart from this, Haryana and Madhya Pradesh are also set to introduce similar laws to check such unlawful religious conversions or love-jihad.

However, several opposition parties had recently termed this decision as an ‘encroachment of personal liberty’ which is being done solely to create division and communal conflict among the people of this country, which was also reflected in the latest judgement by the Allahabad high court.

While allowing the writ petition by Salamat Ansari and Priyanka Kharwar alias Alia of Kushinagar, the judges cited Article 21 of the Constitution that deals with personal liberty.

“To disregard the choice of a person who is of the age of majority would not only be antithetic to the freedom of choice of a grown-up individual but would also be a threat to the concept of unity in diversity,” the Allahabad high court bench added.

“We do not see Priyanka Kharwar and Salamat as Hindu and Muslim, rather as two grown-up individuals who out of their own free will and choice are living together peacefully and happily for over a year,” the court said.

“The courts and the constitutional courts, in particular, are enjoined to uphold the life and liberty of an individual guaranteed under Article 21 of the Constitution of India,” the ruling said.  Through the latest judgement, the high court cleared the air that there is difference between forceful conversions and couples of interfaith marriage living peacefully.

Rename the Mughal Museum at Agra after Shivaji says Yogi Adityanath

Chief Minister of UP Yogi Adityanath has announced to change the name of the Mughal Museum being built at Agra. He said on Monday that the Mughal Museum under construction in Agra will be established in the name of Chhatrapati Shivaji Maharaj. This museum, being based on the eastern entryway of the Taj Mahal, is a project of around 150 crores.
He said that the Uttar Pradesh government will sustain on patriotic thoughts. Yogi said that one needs to separate oneself from the symbol of a servitude mindset, and advance subjects which are beneficial for the country. He stated that Mughals cannot be  made legends. Drawing his usual ideological card, Yogi stated that Chhatrapati Shivaji can be identified as our legend.
CM Yogi has coordinated the travel industry division of the UP government to make a move in this regard. Principal Secretary of Tourism, Jitendra Kumar has been ordered to take action in this matter. According to officials of the tourism department, Mughal objects and documents will be displayed in this museum to be built in Agra. Apart from these, things related to the period of Chhatrapati Shivaji will also be a part of this museum.
The UP government has set a target to spread the glory of Chhatrapati Shivaji through this museum. The government, through the officials of the tourism department, has instructed to make arrangements to display as many things as possible from the period of the early Maratha Empire in the museum. Apart from this, special facilities are also been built for tourists.

UP, Haryana and other 12 states opt for Rs 97,000 crores option to pay GST revenue

On August 27, the 41st GST council took place, where the Union government had offered the states with two borrowing options to help compensate their Goods and Services Tax (GST) revenue shortage of Rs. 2.35 lakh crores. The second option was made available two days after the council, where the states could borrow Rs. 97,000 crores in response to the implementation tailback.

As per two officials from the Union Finance Ministry, 12 states out of 13 have opted for the second option of borrowing 97,000 crores to pay their GST revenue. These states include – Andhra Pradesh (AP), Bihar, Gujarat, Haryana, Karnataka, Madhya Pradesh (MP), Meghalaya, Sikkim, Tripura, Uttar Pradesh (UP), Uttarakhand, and Odisha.

6 other states including Arunachal Pradesh, Mizoram, Himachal Pradesh, Assam, Goa, and Nagaland are yet to decide. They shall disclose their final decision by next week as per the reports.

The Union Government had explained, that if a state chooses the option of borrowing Rs. 97,000 crores for GST revenue, they will be exempted from paying any interest rate. However, upon selecting the 2.35 lakh crores option, the state will have to pay a significant amount as the interest rate which will include the revenue shortage amount due to the Covid-19 pandemic, referred to as the ‘act of God’.

As opposed to this, some other states such as Kerala, New Delhi, Punjab, West Bengal, Chhattisgarh, and Maharashtra, where the ruling body is of the opposition party, criticized this proposal offered by the Central Government.

“FMs of Punjab, Delhi, WB, Chhattisgarh, Telangana and Kerala agreed to reject the Centre’s options on GST compensation. Our option: the central government to borrow the entire compensation due regardless of the acts of God, humans or nature, to be paid back by extending the period of cess.” – tweeted Thomas Isaac, the Finance Minister (FM) of Kerala, on August 31, 2020.

Amit Mitra- the FM of West Bengal, said that the Centre is trying to impel this huge amount of debt on the states in the name of ‘act of God’ – referring to the term used by Nirmala Sitharaman, the FM of India, to describe the pandemic situation.

Manish Sisodia – Delhi deputy Chief Minister described this offer as a ‘betrayal of federalism’.

The Union expenditure, on September 3, 2020, had met virtually with all the state finance secretaries along with the revenue secretaries to elaborate the working of these options. An official also said “Initially, many states, where opposition parties in power, had some reservation related to borrowing. Now, they are weighing their options after the Centre has clarified its commitment to pay the entire compensation. They will also communicate their choices soon.”

After the clarification on the options provided by the Union expenditure, Isaac tweeted “I welcome the new stance of the Centre that it was never its idea to deny full GST compensation. Glad to be corrected. But deferring half the compensation for better times, ipso facto, is deferring public expenditures to better times. It is the surest way of deferring future good days.”- on September 9, 2020.

According to the Attorney General (AG) of India, the GST council was held for the Union government to suggest ways of paying the GST revenue in this time of pandemic, and this job is not to be done by the central government. He said “It was discussed in the recent GST Council meeting that in the current economic scenario it may not be possible to increase tax rates or do rate rationalization to meet the compensation shortfall. However, borrowing could be an option to address this challenge.”
Former FM of India- Arun Jaitley also made a statement “Fulfilling the same commitment, the Central government has, time and again, stated that the entitlement of the states would always be for full compensation and the entire compensation sum on account of shortfall in collections of GST will be paid and honored.” He added that borrowing could be considered as an option in such a time, which can later be repaid by future tax collections.

Foot in Mouth: 6 times Yogi Adityanath raised eyebrows with his controversial statements

Addressing a public rally in support of Citizenship (Amendment) Act in Kanpur, Uttar Pradesh Chief Minister Yogi Adityanath said that anyone who is raising slogans of ‘Azadi’ will be charged with sedition.

Coming down heavily on protestors against CAA, Yogi said that such acts will not be tolerated and the ones practicing it will be charged strictly.

Speaking in Kanpur at a function that’s part of the BJP’s outreach to the people regarding the law, Yogi Adityanath said, “If anyone raises slogans of Azadi in the name of protest, it will amount to sedition and the government will take strict action. It can’t be accepted. People can’t be allowed to conspire against India from Indian soil”.

His statement drew flak from the opposition who slammed Yogi for making such claims. While the Samajwadi Party drew an analogy with the British rule, the Congress termed it “a language of dictators”.
